TV SITES DEALS - TERMS AND CONDITIONS

The following terms and conditions are for the TV Sites Deals on the Enbecom Solutions Website, and should be read in conjunction with all policies and terms and conditions for purchases from Enbecom Solutions.

Package 1- TV Site, domain name and hosting package

After consultation with you, we will design and produce an Enbecom TV Site for your business.  This TV Site is compatible with and accessible exclusively via the Sky Net portal on Sky digiboxes. The TV site can contain up to 10 pages of information and. Each page can contain varying amounts of text, graphics and/or photos, but we reserve the right to charge extra if in our opinion the proposed content will cause us an exceptionally large amount of work.

It is important to note that sites designed for TV are usually less complex than their Internet website equivalents.  This is for a number of reasons including technical limitations of set-top box hardware and software, as well as the need for simple access for TV viewers via their Sky remote control.  In addition, the viewing distance from a TV screen is usually much greater than that from a PC monitor, therefore information on TV Sites need to be presented larger, meaning less information can be displayed per screen.

The price for this offer includes programming of the site in the specialist WTVML programming language.

Package 2 - TV Site, Website, domain name and hosting Package Deal

The following terms and conditions are in addition to those for Package 1, detailed above.

After consultation with you, we will design and produce an Internet Web Site for your business. The website can contain up to 10 pages. Each page can contain varying amounts of text, graphics and/or photos, but we reserve the right to charge extra if in our opinion the proposed content will cause us an exceptionally large amount of work.

The price for this offer includes programming in HTML only, which is adequate for the majority of business requirements.

Further Terms and Conditions for both Packages

To provide these offers at such a low rate, communication between both parties when providing the service is provided on a 'mail order' basis, i.e. by phone, email, post and fax.  The price of this offer does not include any costs relating to face-to-face meetings, e.g. time and travel.

We may place a small electronic 'banner' advertisement on your TV Site and/or Website directing people towards our TV Site and/or Web Site. The image may change in appearance from time to time.

The price for these offers includes two years' registration of your chosen domain name (if available). There is no obligation to renew the domain registration after this time, but the domain will cease to function if registration is not renewed.

The price for these offers includes two year's site hosting, which can basically be described as storage space for the files which make up your TV Site and/or website on a computer permanently connected at high speed to the Internet. There is no obligation to renew hosting after this time, but your TV Site and/or website will cease to function if it is not renewed.

Domain name registration and web hosting as described above is initiated usually within 72 hours of your order, and not when you send us information relating to your business which we will use to produce your website.

A condition of Package 1 and Package 2 is that if the relevant domain name or site hosting is already being provided, it must be transferred to Enbecom Solutions.  This usually provides technical and service benefits anyway but in any case, two year's domain name and hosting service is included in the price of both Packages.

You, the Customer, will be responsible for carrying out your part of the procedures for transferring the domain name registration and hosting to Enbecom Solutions. This may incur a charge from your existing provider of these services, which you will be liable for. In certain circumstances, due to technical or other reasons beyond our control, it is not possible to transfer domain registration or hosting from your existing provider. If this is the case, we are unable to provide this offer to you, but we may be able to provide service based on our standard prices detailed on our Web site.

Because we believe in personal service, we may contact you to confirm your requirements before processing an order fully. Enbecom Solutions reserves the right to wholly or partially refuse any order.

These offers are available to orders placed through Enbecom Solutions from April 18th 2006 - 2005 - October 31st 2007. The date of placing the order will be the basis for determination of qualification. These offers are available to businesses who are new or existing customers of Enbecom Solutions, based in mainland Great Britain.

The Sky Net platform is operated independently of Enbecom Solutions.  As such, Enbecom Solutions cannot make any warranties or guarantees relating to the reliability of the Sky Net platform.  Furthermore, the Sky Net platform may be withdrawn temporarily or permanently by its operators without notice.  To the maximum extent permitted by law Enbecom Solutions will not provide any refund or other financial compensation in the event of disruption to, or withdrawal of, the Sky Net platform.

TV Sites must comply with the Sky Net Terms and Conditions and content requirements as well as all Enbecom Solutions Terms and Conditions.  It is your responsibility to ensure compliance with these Terms and Conditions and content requirements.  Enbecom Solutions will ensure that your site complies with Sky Net technical requirements until such time as you begin to make alterations to the TV Site yourself.  However, it is emphasised that this assurance of compliance relates to technical matters only and content is a matter for yourself. 

Information used to develop TV Sites can normally be taken from existing websites.  However, if there is additional information to include and/or if no website currently exists, it is your responsibility to provide us as soon as possible with all information regarding your business which you want to include in your TV Site and/or website, including any rough notes or designs, plus brochures, photographs, text (including text which must by legal requirement be included in your TV Site and/or website), and any other media. If all of this information is not received by us at the LATEST of either the closing date of this offer or EIGHT weeks after the date of placing your order, we will either complete production of your TV Site and/or website with the information received (if any information has been received), or design and place online a basic TV Site and/or website containing your business contact details (if no information has been received). We will not return any fees (subject to statutory rights held by us or you).

***The information below this paragraph and until *END OF ADDITIONAL TERMS FOR EXISTING WEBSITES* below applies in addition to the other paragraphs if your business already has a website and Package 2 is being ordered***

If your business already has a website, then optionally, after consultation with you, we will obtain the individual files which make up your existing Internet Web Site, and alter and update them to your requirements. There must be no more than 10 pages which need changing (we will of course attempt to preserve the other pages). We reserve the right to charge extra if in our opinion the proposed changes will cause us an exceptionally large amount of work.

You will need to provide us with the individual files which make up your existing website, on media such as CD-ROM. In exceptional circumstances we can obtain files direct from the existing Internet location of your website (ie by visiting your website and downloading the files to our machines), but this method is not technically ideal and we may charge an extra fee for this.

You, the Customer, are responsible for ensuring that none of the individual files and programming which make up your existing Internet Web Site are subject to any restrictions, legally or otherwise, including (but not limited to) copyright restrictions or rules on altering the code or layout.

Domain name registration and web hosting as described above is initiated usually within 72 hours of your order, and not when you send us information relating to your business which we will use to update your website.

These offers cannot be used in conjunction with any other offer.

Enbecom Solutions' decision is final in any disputes. This does not affect any statutory rights.
